These Terms and Conditions apply to purchases made through the website www.leahjordan.art, operated by Leah Jordan. By placing an order through this website, you agree to these Terms and Conditions.

If you are purchasing from me as a consumer, nothing in these Terms and Conditions affects your statutory rights.

2. My artwork

I create handmade ceramic sculptures and artworks. Each piece is individually made and may contain small variations in colour, texture, glaze, surface, shape or finish. These variations are inherent characteristics of handmade ceramic artwork and are not considered faults where they are consistent with the description and photographs of the piece. Where an artwork has a specific characteristic, limitation or intended use, this will be stated in its product description. Unless expressly stated otherwise, my ceramic sculptures are artworks for display and are not intended for food use.

3. Product information and photographs

I make reasonable efforts to ensure that descriptions, dimensions, photographs and colours of artwork on this website are accurate. Colours may appear slightly different depending on your screen or device. Dimensions are approximate and may vary slightly due to the handmade nature of the work.

4. Prices

All prices are displayed in pounds sterling (£). The price payable is the price displayed on the website at the time you place your order, together with any applicable delivery charges. I reserve the right to change prices at any time, but changes will not affect an order that I have already accepted.

5. Placing an order

When you place an order through the website, you are making an offer to purchase the artwork shown in your order. After placing an order, you should receive an acknowledgement confirming that your order has been received. A contract between us is formed when I confirm that your order has been accepted.

I reserve the right to refuse or cancel an order where, for example:

• the artwork is no longer available;

• there has been an obvious error in the product description or price;

• I am unable to fulfil the order; or

• there is a problem with the payment.

If I cancel an order after you have paid, I will refund the amount you have paid.

6. Payment

Payment is made through the payment methods made available at checkout. Payment must be received before your artwork is dispatched.

7. Delivery

I currently deliver to addresses within the United Kingdom only. Delivery costs and estimated delivery times are shown at checkout or on the relevant product/delivery information page. I will normally dispatch artwork within 3 working days of receiving your order unless a different dispatch period is stated on the product page. Once your artwork has been dispatched, you will receive any available tracking information. I will take reasonable care when packaging artwork for delivery. However, because ceramic artwork is fragile, there is always some risk of damage during transit. If your artwork arrives damaged, please contact me as soon as possible and see my Delivery and Returns Policy.

8. Risk and ownership

Responsibility for the artwork passes to you when you, or a person you have nominated to receive the goods (other than the delivery carrier), physically receive it. Ownership of the artwork passes to you once I have received full payment and the artwork has been delivered.

 

9. Your right to cancel an online order

If you purchase artwork online as a consumer, you generally have a statutory right to cancel your order within 14 days of receiving the artwork, without giving a reason. Further information about cancellation, returns and refunds is provided in my Delivery and Returns Policy. This statutory cancellation right does not apply to every type of order. For example, certain personalised or bespoke goods may be excluded from the cancellation right where the law permits. Nothing in these Terms & Conditions affects your statutory rights.

10. Faulty or damaged artwork

If artwork is faulty, damaged, not as described or otherwise does not conform to your legal rights, please contact me. I will assess the issue and provide the remedy you are legally entitled to, which may include a repair, replacement or refund depending on the circumstances. Please do not dispose of damaged or faulty artwork before contacting me unless it presents a safety risk.

11. Intellectual property

All photographs, artwork images, written content, designs, logos and other material on this website are owned by me or used with permission. You may not reproduce, copy, modify, distribute or commercially use my artwork, photographs, website content or designs without my written permission. Purchasing an artwork does not transfer copyright or other intellectual property rights in the artwork to you.

12. Website availability

I make reasonable efforts to keep this website available and accurate. However, I cannot guarantee that the website will always be available, uninterrupted or free from errors. 

 

13. Limitation of liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory consumer rights that cannot legally be excluded. Subject to this, I will not be liable for losses that are not reasonably foreseeable arising from your use of the website or purchase of artwork.

14. Privacy

Personal information provided when you place an order, contact me or subscribe to my mailing list is handled in accordance with my Privacy Policy.

15. Governing law

These Terms & Conditions are governed by the law of England and Wales. If you are a consumer living elsewhere in the UK, you may also have rights under the mandatory consumer protection laws applicable in your part of the UK.
